After RiksTV did not accept TONO's claim for damages following its victory in the Supreme Court in December 2018, TONO has been forced to issue a new summons. – We are disappointed, and one wonders whether RiksTV has realized that they have lost a case in the Supreme Court, says TONO CEO, Cato Strøm.
/ 04/06/2019 / Willy MartinsenIt is a long-running case that TONO is trying to end. The first summons was issued in 2012, and TONO first won in Oslo District Court in 2016, then City Council Court of Appeal in 2017 and finally in Supreme Court in December 2018. The judgment established that RiksTV makes musical works available to the public, and has a responsibility to clear the performance rights with TONO.
The parties have negotiated over the winter about the amount of compensation and have given themselves a deadline of May 14. However, they have not been able to reach an agreement. TONO's claim for 105 million was therefore presented in a procedural document to the Oslo District Court on May 16.
– We are disappointed, and one wonders whether RiksTV has realized that they have lost a case in the Supreme Court. Another round in court should be unnecessary, but we are prepared to do what we have to do to get what we believe is the right level of compensation, says TONO CEO, Cato Strøm.
TONO expects that Oslo District Court will schedule a main hearing sometime during the second half of 2019.
