HBO Max and TONO have reached an agreement regulating the use of music on the service. This means that TONO members who have music in films that are watched on HBO in Norway will receive TONO revenue for this.
/ 20/12/2021 / Willy Martinsen– We are pleased to have reached an agreement with HBO Max. This means that composers, lyricists and music publishers that TONO represents will receive TONO revenue when their music is used in films that are watched on the service, says Inger Elise Mey, Director of Online Media at TONO.
It is the Copyright Act that gives music creators the right to control their own works. As TONO members, creators entrust TONO with giving consent for public performance, for example on a video streaming service such as HBO Max. The agreement also regulates how HBO Max will report to TONO what has been performed. The reports enable precise billing to the correct rights holders. The agreement gives TONO both a larger financial settlement for the time HBO Max and before that HBO Nordic have been present in the Norwegian market up until now, but also clear frameworks for future use.

The agreement between TONO and HBO Max covers the Norwegian version of HBO Max, i.e. the money Norwegian HBO Max customers leave with the service. For HBO Max services anywhere in the world outside Norway's borders, HBO Max revenues come to TONO's members as part of foreign revenues. TONO settles for viewings on streaming services four times a year – March, June, September and December.
In addition to the new agreement with HBO Max, TONO has services such as Netflix, Disney, Amazon Prime, Viaplay, Apple, SF Anytime, BlockBuster, Altibox, iTunes, NorgesFilm, Google Play and more in its customer portfolio of video streaming services.
About TONO:
TONO was founded in 1928 and is a non-profit cooperative owned and managed by authors (composers and lyricists) and music publishers, and on their behalf manages the economic copyrights in the music they have created. TONO has more than 37,000 members, but also works with millions of authors and music publishers from around the world. TONO gives music creators an economic basis to create new music, and collects and simplifies the licensing of protected music to music users. TONO had a turnover of NOK 712,4 million in 2020.
