As a TONO member, can I self-manage my music?

As a TONO member, you entrust TONO with licensing all public performance, transmission and sound recording of your music. You still have the opportunity to manage your music yourself in a number of areas.

Non-commercial use

Will your music be performed at an event to raise money for a charitable cause? You can grant permission for non-commercial use of your musical works. The following conditions must be met:

Production music/Library works

As of January 2016, TONO offers its members self-management of production music (also called Library Music). Self-management applies to the mechanical rights areas of synchronization and copying.

This means that our members can negotiate prices themselves with production companies that use libraries of music specifically created for film, TV, radio and advertising.

Production music is not distributed to the general consumer, but is normally made available to production companies who are free to choose which musical works they want to use in, for example, an audiovisual production.

Definition of production music

Production music is defined as follows: A musical work, without a commissioner, that is published solely for non-exclusive use in audio and audiovisual productions.

The musical work is created primarily for use by production companies and various enterprises that can use the work as background music in their own audio and video productions.

How to review production music

The musical works are first notified to TONO in the usual way.

You then submit an application form stating which works you wish to transfer back to self-management.

The works are marked as Library (LIB) in our systems. This means that they are exempt from NCB's ordinary mechanical management.

It is important to be aware of the following points:

Rights categories

TONO members basically leave all rights categories to TONO's management, but also have the option to handle one or more categories themselves (see overview below). An extraction of a rights category will include all of the member's works in the relevant rights category. It is not possible to extract management at the work level or, for example, works from a specific publisher.

If a TONO member wishes to have the works within one or more categories handled outside TONO, the works will not be covered by TONO's agreements with our customers, and the member will therefore not receive payment via TONO for these categories. TONO will also not be able to assist the member in cases of non-payment, etc. in categories handled outside TONO.

Deadline

If a TONO member wishes to withdraw categories from TONO's management, this must be done with six months' notice before the end of a calendar year. For example, if the categories are to be removed from TONO's management with effect from 1 January 2024, the member must notify TONO of this no later than 30 June 2023.

The categories

The individual European collective management societies can determine their own categories, which in practice means that they will vary from country to country. These are TONO's rights categories:

  1. Recording on audio media
    "Phonogram-mechanical", for example when using music on CD and LP releases.
  2. Recording on audiovisual media
    "AV-mechanical", for example when using music in DVD releases and games.
  3. Synchronizing
    The use of music in a way that juxtaposes sound and moving images, for example when music is used in a film or television production.
  4. General public performance
    For example, when using music for concerts and cinema screenings. Also covers background music.
  5. Broadcasting on radio and television
    For example, when using music in broadcasts on radio and TV stations broadcasting from Norway, as well as further distribution of radio and TV broadcasts. Also covers cable TV, "retransmission".

    Please note that the agreement between TONO and NRK has the effect of a contractual license. Read more about this below.

Areas with contractual license
In areas where agreements have been entered into with contractual licensing effect, it will not be possible to remove the rights from TONO's management. This type of license means that a management company enters into an agreement on behalf of all rights holders within a rights area, and the arrangement is regulated in the Copyright Act. This includes contractual licensing on TONO's agreement with NRK and on the agreements entered into through Norwaco (TV distribution, NRK Archives, etc.).

 

Great rights

Performances of originally written music-dramatic works, or musical works performed on stage in a dramatic context (Opera, ballet, musical and similar), are not subject to TONO's management.
