TONO's obligations to members:
Licensing shall ensure that authors of musical works receive a fair remuneration when their music is performed. TONO's role is to act as an intermediary between the customer and the author. The starting point for TONO's management is the Copyright Act, and the basis for license terms and principles is the Collective Management Act. TONO shall contribute to the fulfillment of the Copyright Act's purpose §1 (a) "to grant rights to those who create, perform or invest in intellectual works or related achievements and works, and thus also provide incentives for cultural production". TONO follows the regulations - even where the law has exceptions, so that we ensure authors receive a fair remuneration when performance takes place. TONO shall market the repertoire we are assigned to manage, in the sense that original music has high commercial value - this is the core message of our licensing work.
Basis for licensing
TONO licenses the use of music within several customer areas and manages performance rights on behalf of rights holders. It is the rights holders who set the conditions for granting a license and the author can refuse permission if the customer rejects the conditions. TONO manages the world repertoire through its reciprocal agreements with sister societies.
Principles for granting a license:
The main rules that form the basis of TONO's licensing principles are found in the Copyright Act §3 a) and b) and in the Collective Management Act §28.
Main principles for TONO's licensing:
- Permanent or temporary copy production
- The music is made available to the public – extent of availability
- The remuneration/price must be reasonable
- Economic trade value for the performance
- Scope and nature of music use
- Separate objective and non-discriminatory criteria are set for all customer areas in order to grant a license for music use.
TONO's commitment to the customer: - License terms must be objective and non-discriminatory
- Exercise predictability towards the customer
- Provide necessary information so that the customer can obtain a license
- Provide a documentable basis for licensing through transparent and published conditions and pricing models
